可疑交易申報係我國洗錢防制法為防範洗錢犯罪,課予銀行業的義務之一,惟我國對於可疑交易申報之重視程度,係近年才有意識地提升,致實際執行成果與國際規範有所落差。尤其在銀行業者實務經驗累積尚不足之情況,可疑交易之識別、監控與申報上,面臨諸多困境。於「法規定義」上,風險基礎法以風險為本之核心理念,具有不確定及不可預測性,為我國金融管制及可疑交易申報相關制度之實行帶來衝擊;企業執行面上,「公司政策」對於洗錢防制之重視程度、金融機構前線人員與客戶之關係等「個人因素」,以及如何應變外部規範快速轉變並分配可疑交易申報與洗錢防制任務之「組織壓力」,同樣影響申報制度之有效性與效率。以法規定義、公司政策、個人因素

與組織壓力四大要素為基礎,並配合「決策實驗室分析方法」,本文研究發現管制方法等法規層面上之轉變,為影響可疑交易申報施行之最主要因素。故以法規定義層面為主軸,企業執行面為輔,提出以下建議。首先,金融情報中心、金融主管機關與銀行業者間合作與交流的建立,為解決管制方法轉變衝擊之根本。我國應認識到可疑交易申報資訊於預防層面上的重要性,並應建立可疑交易資訊相關主體間溝通與合作關係,緩解洗錢防制法對金融集團內可疑交易申報資訊分享之限制。其次於企業執行面,銀行業者應持續累積洗錢防制之專業能力與經驗,積極投入人力資源,亦須建立適當之內部考核制度,並定期舉行跨部門會議以協調洗錢防制任務分配上之衝突;金融主管機關

方面則應提供適當之訓練機會,及設置獎助措施,盡可能降低成本為銀行業者帶來的負擔。最後,主管機關與金融機構雙方之相互信任,同樣也是改善我國銀行業可疑交易申報之關鍵。
